When the Key Dies With You: Protecting Your Crypto Across Generations Under US Law

There is a particular cruelty in the scenario that estate attorneys are now encountering with growing frequency across the United States. A family member dies. The survivors know — perhaps from an offhand comment, perhaps from a brokerage statement — that the deceased held cryptocurrency. Possibly a great deal of it. And yet no one can access it, because no one knows where the seed phrase is, or what a seed phrase even is, or that the hardware wallet sitting in a desk drawer is the only gateway to assets that may represent years of accumulated wealth.
This is not a rare edge case. It is a foreseeable outcome of the collision between self-custody's core design principle — that no third party controls your assets — and the legal architecture of American inheritance law, which was built for a world of banks, brokerages, and paper deeds.
The Structural Mismatch
Under US probate law, the transfer of assets at death depends on the ability to identify, value, and transfer those assets. For traditional financial accounts, this process is well-worn: institutions receive death certificates, verify beneficiary designations, and transfer funds through established procedures. The legal system has decades of case law and regulatory guidance supporting every step.
Self-custody cryptocurrency operates on entirely different logic. Ownership is not recorded in a ledger maintained by an institution. It is cryptographically enforced by control of a private key — typically represented as a 12- or 24-word seed phrase. Whoever holds that phrase controls the assets, regardless of what any will or court order says. A probate judge cannot compel a blockchain to release funds. A court-appointed administrator cannot call customer service. If the seed phrase is lost, the assets are lost. Permanently.
This creates a situation where the legal right to an asset and the practical ability to access it are entirely disconnected. A surviving spouse may be the lawful heir to $400,000 in Bitcoin and simultaneously have no mechanism whatsoever to claim it.
Why Standard Estate Documents Fall Short
The instinct of many crypto holders who do think about this problem is to address it through conventional estate planning — a will, perhaps a trust. This instinct is correct in spirit but insufficient in execution.
A will can direct that cryptocurrency holdings transfer to a named beneficiary, but it cannot transfer them. The executor of an estate has legal authority but not cryptographic authority. Unless the will is accompanied by documented access information — the seed phrase itself, or clear instructions for retrieving it — the legal directive is unenforceable in practice.
Revocable living trusts, commonly used to avoid probate in states like California and Florida, face the same limitation. The trust can hold cryptocurrency as an asset class, but the trustee's ability to administer that asset depends entirely on whether they have the private key material necessary to move it.
Durable powers of attorney, which allow a designated agent to manage financial affairs during incapacity, present a related problem. Most financial institutions recognize these documents automatically. Blockchains do not recognize any documents. An agent with power of attorney over a self-custody wallet is legally empowered and practically helpless without the cryptographic credentials.
The Probate Court's Impossible Position
When crypto assets enter probate without accessible credentials, courts are left in an untenable position. Several states — including Wyoming, which has been the most aggressive in developing digital asset law — have passed legislation recognizing cryptocurrency as property and addressing some aspects of fiduciary access. The Uniform Law Commission's Revised Fiduciary Access to Digital Assets Act has been adopted in varying forms across most states.
But these frameworks address the legal right of fiduciaries to access digital assets. They do not solve the technical problem of what happens when the access credentials no longer exist. A Wyoming statute cannot recover a lost seed phrase. The legal infrastructure, however well-intentioned, is built on an assumption that the technical access problem has been solved separately.
In practice, probate courts dealing with inaccessible crypto assets have limited options: order blockchain analytics to establish ownership for valuation purposes, write off the assets as unrecoverable, or — in cases involving custodial exchange accounts rather than self-custody wallets — work through the exchange's legal process for deceased account holders.
Practical Frameworks That Actually Work
The good news is that the problem is solvable, though the solutions require deliberate action while the holder is alive and mentally capable.
Documented credential storage. The seed phrase must exist somewhere accessible to trusted parties after death. Options range from physical storage in a fireproof safe with instructions in the will, to professional custodial services that hold encrypted backups, to attorney-held sealed envelopes. The critical point is that the information must exist in a retrievable form that survives the holder's death.
Multi-signature wallet structures. A multisig wallet requiring, for example, two of three key holders to authorize a transaction can distribute access across a trusted attorney, a family member, and a secure backup location. No single point of failure exists, and no single party can unilaterally move funds — addressing both the inheritance access problem and the theft risk that makes some holders reluctant to share key material.
Dedicated crypto provisions in estate documents. Estate attorneys with digital asset experience can draft specific provisions that go beyond generic references to "digital assets" and instead provide explicit instruction sets: where credentials are stored, in what form, under what conditions they should be accessed, and which assets they control. Vague language creates ambiguity; specificity creates a workable roadmap.
Letter of instruction. Separate from the formal will — which becomes a public document in probate — a private letter of instruction can contain the operational details an executor needs. This document should be updated whenever wallet configurations change and stored with the same care as the will itself.
Beneficiary education. Perhaps the most undervalued element. An heir who does not understand what a hardware wallet is, has never used a cryptocurrency exchange, and cannot distinguish a seed phrase from a password is not equipped to recover assets even with perfect documentation. Some degree of practical education — even a single conversation — dramatically improves recovery outcomes.
A Problem That Will Only Grow
The demographic reality of American crypto adoption means this issue will compound over the next decade. Early Bitcoin adopters are aging. The cohort that entered the market during the 2017 and 2020 cycles is now well into adulthood, with spouses, children, and accumulating wealth. The assets are real. The planning, in the vast majority of cases, is not.
US estate law will continue to adapt — slowly, unevenly, and with significant variation by state. But legal adaptation cannot substitute for individual preparation. The self-custody model's greatest strength, the elimination of third-party dependency, is simultaneously its most dangerous inheritance characteristic. The only party who can bridge the gap between cryptographic control and legal transfer is the holder themselves, while they are still alive to do it.
